In 1999 the European Council for Fatwa and Research issued a fatwa permitting Muslims in Europe, on the basis of need (hajah) treated in the place of necessity (darurah), to purchase a first home with a conventional interest-based mortgage where a genuinely halal alternative is unavailable and all other options (renting, relocating, halal finance, family pooling) have been exhausted. The ruling rests on the maxim that need can be given the standing of necessity. It is openly contested: many scholars and councils reject it, holding that home ownership does not meet the fiqh threshold of darurah and that the principal injunction against riba is not lifted by the desire to own rather than rent.
